Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Brkrr platform operated by Brkrr Technologies Inc. ("Brkrr", "we", "us", or "our") at brkrr.ca. By creating an account or using the Platform you agree to be bound by these Terms. Our Privacy Policy is incorporated by reference and governs our collection and use of your personal information.

1. Definitions

"Platform" means the Brkrr website at brkrr.ca and all related services
"Consumer" means a person using the Platform to search for or connect with mortgage agents
"Agent" means a licensed mortgage agent or broker who has claimed or registered a listing on the Platform
"Listing" means a mortgage agent's profile page on the Platform
"Lead" means a consumer's enquiry submitted through the Platform and matched to one or more Agents
"Content" means any information, text, images, or data you submit to the Platform
"Registry" means a provincial or territorial regulatory authority's public mortgage agent or broker licensing database

2. Eligibility

You must be at least 18 years of age to use the Platform. Agents must hold a valid mortgage agent or broker licence issued by a Canadian provincial or territorial regulator. Misrepresenting your licensing status is grounds for immediate account termination. By using the Platform you represent and warrant that you meet these eligibility requirements.

3. Accounts

3.1 Registration

To access certain features you must create an account using Google OAuth or LinkedIn OAuth. You agree to provide accurate, current, and complete information and to keep it updated.

3.2 Account security

You are responsible for all activity that occurs under your account. Notify us immediately at support@brkrr.ca if you suspect unauthorized access.

3.3 One account per person

Each person may maintain only one account. Agents may not create consumer accounts to submit leads to themselves or otherwise manipulate the matching system.

4. Consumer Terms

4.1 Cost to consumers

The Brkrr Platform is free for consumers to use — we do not charge you to search the directory, view agent profiles, or submit lead requests. Mortgage agent compensation and any broker fees are disclosed by the mortgage agent and are governed by your engagement with that agent, not by Brkrr.

Note on broker fees: Mortgage agent compensation varies by mortgage type. For A-lender mortgages, agents are typically paid by the lender. For B-lender or private mortgages, agents may charge a broker fee, which must be disclosed to you in writing. Always ask your agent about fees before proceeding.

4.2 Lead submissions

When you submit a matched lead, your enquiry details are shared with up to three verified mortgage agents in your province who match your needs. All three agents may independently accept the match. You consent to being contacted by those agents in connection with your enquiry. Your email address and phone number are shared with a matched agent only after that agent accepts your lead.

When you submit a lead directly from a specific agent's profile page, your lead is shared only with that agent.

4.3 No financial advice

Brkrr is a directory service. We do not provide mortgage advice, financial advice, or any recommendation as to which agent, lender, or product you should choose. Your mortgage decisions are your own responsibility. Brkrr is not a mortgage lender, mortgage broker, or mortgage agent.

4.4 Agent independence

Agents listed on the Platform are independent licensed professionals. Brkrr is not a party to any mortgage transaction and does not guarantee the quality, suitability, terms, or outcome of any agent's services. No guarantee is made that any specific mortgage agent will accept any matched lead, or that any mortgage application will be approved.

5. Agent Terms

5.1 Eligibility and verification

To claim or register a listing, you must hold a valid mortgage agent or broker licence issued by a Canadian provincial or territorial regulator. You authorise Brkrr to verify your licence against the relevant provincial public registry at any time, including nightly automated checks.

5.2 Accuracy of information

You are responsible for the accuracy of all information in your Listing. You must update your Listing promptly if any information changes, including your brokerage, contact information, or areas of service.

5.3 Licence maintenance

You must maintain a valid licence throughout your use of the Platform. If your licence expires, is suspended, or is revoked, your Listing will be hidden automatically and you must notify us immediately at support@brkrr.ca. Brkrr checks licence status nightly against public provincial registries.

5.4 Lead handling

Leads are provided on a non-exclusive basis — up to three agents may receive the same matched lead and may all independently accept it. You must:

Respond to matched leads promptly and professionally
Not contact consumers for purposes unrelated to their stated mortgage enquiry
Comply with all applicable telemarketing and anti-spam laws, including CASL
Not share consumer lead data with third parties without the consumer's consent

5.5 Reviews

You may not solicit reviews in exchange for compensation or any other benefit. Attempting to manipulate, fabricate, or remove legitimate reviews is grounds for immediate account termination.

5.6 Subscription tiers

The Platform is currently provided without charge to mortgage agents in its base configuration. Brkrr may offer paid subscription tiers in the future that unlock additional features or lead volume. Any such tiers will be subject to separate billing terms presented at the time of purchase. You are under no obligation to subscribe to a paid tier.

5.7 Listing rights

Regarding your listing on the Platform:

Unclaimed listings are built from publicly-available provincial regulatory registry data. The legal basis for this is described in our Privacy Policy §2.3.
You may claim your listing at any time by following the claim flow.
You may request takedown of an unclaimed listing by emailing privacy@brkrr.ca with your licence number and provincial regulator confirmation. We will hide the listing within 14 days and will maintain a suppression record to prevent re-creation from subsequent registry synchronizations.
Once claimed, you may update any field in your profile other than your licence number, brokerage name (synchronized from the registry), and licence status (synchronized from the registry).
You may close your account at any time. On closure, your listing is hidden from the directory. Provincial registry information remains publicly available at the relevant registry.

6. Prohibited Conduct

You may not:

Use the Platform for any unlawful purpose
Impersonate any person or entity or misrepresent your affiliation or licensing status
Submit false, misleading, or fraudulent information
Circumvent, disable, or interfere with Platform security features
Scrape, crawl, or systematically extract data from the Platform without authorization
Use automated tools to submit leads, create accounts, or interact with the Platform
Send unsolicited commercial messages in violation of CASL or other applicable law
Use any agent contact information obtained through the Platform for any purpose other than discussing a bona fide mortgage enquiry
Compile, copy, or extract a list of agents or agent contact information for resale or commercial purposes
Submit lead requests on behalf of a third party without their express consent

7. Intellectual Property

7.1 Brkrr's intellectual property

The Platform, including its design, software, trademarks, and content created by Brkrr, is owned by Brkrr Technologies Inc. and protected by Canadian and international intellectual property law. Registry data displayed on the Platform is sourced from public regulatory sources as described in our Privacy Policy.

7.2 Your content

You retain ownership of Content you submit. By submitting Content, you grant Brkrr a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that Content on the Platform for the purpose of operating the service. You represent that you have all necessary rights to grant this licence.

8. Future Paid Plans

Brkrr may offer paid plans in the future, subject to separate billing terms. If and when paid plans are introduced, you will be presented with clear pricing, billing cadence, and cancellation terms before any charge is made. Your continued use of free Platform features is not conditioned on subscribing to any paid plan.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Brkrr does not warrant that:

The Platform will be uninterrupted or error-free
Any information on the Platform is accurate, current, or complete
Any specific mortgage agent will accept any matched lead
Any mortgage application will be approved, or that any particular rate or term will be offered by any agent

Brkrr is not a mortgage lender, mortgage broker, or mortgage agent and does not give mortgage advice.

10. Limitation of Liability

To the maximum extent permitted by applicable Canadian law, Brkrr and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total aggregate liability for any claim arising from or relating to these Terms or your use of the Platform shall not exceed the greater of: (a) the amount you paid to Brkrr in the twelve months preceding the claim; or (b) one hundred Canadian dollars ($100 CAD).

11. Indemnification

You agree to indemnify, defend, and hold harmless Brkrr and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Platform, your breach of these Terms, or your Content.

12. Termination

We may suspend or terminate your account at any time, with or without prior notice, for conduct that violates these Terms or applicable law, or for any other reason at our sole discretion. You may close your account at any time through your account settings. On termination, provisions that by their nature should survive (including Sections 7, 9, 10, 11, and 13) will continue to apply.

13. Governing Law and Dispute Resolution

13.1 Governing law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

13.2 Dispute resolution

We encourage you to contact us first at legal@brkrr.ca to resolve any dispute informally. If a dispute cannot be resolved informally, the parties will work together in good faith to identify an appropriate resolution mechanism, which may include mediation, arbitration, or court proceedings, as appropriate to the nature and amount of the dispute.

Nothing in this section prevents either party from seeking interim injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm.

14. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Brkrr regarding the Platform. We may modify these Terms at any time with at least 30 days' notice for material changes, provided by email or prominent notice on the Platform. Continued use after the effective date of any modification constitutes acceptance of the updated Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
